To be considered ‘competent’, an individual must have sufficient training, experience and knowledge of health and safety in order to assist you properly.
Within the Management of Health & Safety at Work Regulations 1999 there is a requirement for every employer to have, where necessary, the services of a “competent person” and this is defined as:
Every employer shall appoint one or more competent persons to assist him in undertaking the measures he needs to take to comply with the requirements and prohibitions imposed upon him by or under the relevant statutory provisions
The HSE advises that employers who aren’t confident in their ability to manage health and safety internally should seek support from an external health and safety professional.
